  • Race based discrimination: Under Title VII, an employer may not use race as a basis for hiring, promotion, layoffs or any other employment decision.  Race discrimination may include race based comments, racial epithets, derogatory slurs or other race based comments, policies or conduct.

  • Gender based discrimination: Title VII also prohibits using sex or gender as a basis for employment decisions including hiring decisions, layoffs or termination, raises, promotions or other similar terms and conditions of employment. The Equal Pay Act additionally requires that men and women receive comparable compensation for comparable positions.

  • Religious discrimination: An employer may not discriminate on the basis of religious belief or practice.

  • Age discrimination: Employees over the age of forty are protected from workplace discrimination by the Age Discrimination in Employment Act. The act prohibits using age as a basis for decisions to hire, fire, discriminate in pay or commit other forms of age based discrimination in the workplace.

  • National origin discrimination: National origin and ethnicity may also not be used in employment decisions like decisions to hire, terminate, denial of promotions and pay increase or other employment related policies.

  • Disability discrimination: The Americans with Disabilities Act (ADA) not only prohibits discrimination in employment decisions and polices based on disability but also requires employers to make reasonable accommodations for employees who are otherwise qualified.

  • Sexual harassment and hostile work environment: Title VII prohibits sex or gender based discrimination in the workplace. The conduct prohibited extends to quid pro quo situations where hiring, firing or other employment benefits are directly impacted by rejection of unwanted sexual advances. Hostile work environment sexual harassment is also prohibited including sexual comments, circulation of pornography, offensive touching, comments on one's body, sexual jokes and other similar conduct that is severe and pervasive.

  • Pregnancy discrimination: The Family Medical Leave Act (FMLA) prohibits employers from terminating employees for taking time off for pregnancy, child birth and care of a new child. The FMLA authorizes twelve weeks off work for pregnancy, childbirth and care of a new child. Employers may search for pretexts to terminate pregnant employees to avoid the costs associated with maternity leave. If you take time off work under the FMLA, you have a right to return to your position without a change in pay or loss of seniority.

I booked, promoted and produced over 500 live concerts, featuring such diverse artists as Willie Nelson and Waylon Jennings to Jackson Browne, Bonnie Raitt, Graham Nash and Joni Mitchell, to Jerry Lee Lewis and Little Richard. I employed and supervised a large group of workers with very diverse backgrounds and interests. I learned then what I still swear by today-ability to do the work is all that matters in the workplace. Not race, age, sex or anything else...just ability... The broad scope of my experience also extends to being the Owner and General Manager of the Tulsa Ice Oilers, the farm team of the Winnipeg Jets, and later, the New York Rangers. My eclectic mix of experiences as both a business owner and musical performer has provided me with a unique understanding and perspective so that you will not be faced with the impersonal perspective of attorneys who focus on representing large corporations with background and experience limited to law school and law firm settings.
